Accommodation of Passengers in Different Class

Were you accommodated in an INFERIOR CLASS?

You have the right to be compensated!!!

If an operating air carrier places a passenger in a SUPERIOR CLASS than that for which the ticket was purchased, no additional payment can be claimed.

If an operating air carrier places a passenger in an INFERIOR CLASS than that for which the ticket was purchased, the passenger is entitled to be reimbursed within seven days:

a) 30 % of the ticket price for all flights equal to or less than 1,500 km;

b) 50 % of the ticket price for all intra-community flights of more than 1,500 km, except flights between the Member States on the territory of the European Union and the French departments overseas, and for all flights between 1,500 and 3,500 km;

c) 75 % of the ticket price for all flights not falling in the cases referred to in sub-paragraphs a) or b), including flights between the Member States on the territory of the European Union and the French departments overseas.




Some court decisions:


The Justice of the Peace for Palermo, in a case where a tourist was accommodated in an inferior travel class instead of the first class, with subsequent discomfort for the documented pathology (claustrophobia and panic attack) and also with a prolonged stopover in Zanzibar (12 hours instead of one) without adequate assistance, condemned the air carrier to pay, as compensation for damages, the total sum of Euro 1,153.00 of which Euro 600 equal to 75% of the ticket cost, Euro 203.00 for incurred expenses and Euro 350.00 for non-pecuniary damage.
