Theft at Hotel

Being sure of the safety of the hotel chosen, the last thing you think of is that someone can steal your most precious objects. From the room to the hotel lobby, from the common spaces (internal and external) to the parking lot, the theft could happen in different places, but the law protects us in this case also.

It's good to know that those who stay at a hotel or at an organized tourist camp and suffer theft during their stay there have the right to obtain compensation for damages corresponding to the value of items unfairly stolen. The signs at the hotel warning customers of the exemption of liability for theft have no value.

The only limitation of liability of the hotel director is that in the event that the client, provided with a safety deposit box, has failed to deposit the objects in the box; in this case, the accommodation provider is liable for a maximum value equal to one hundred times the price of accommodation per day.

Some court decisions:

The Court of Cassation, in a recent ruling (Case 10493/2009), has fully admitted the case of a Roman tourist who, the night before leaving the hotel had withdrawn her fur coat and, during the night, someone entered her room stealing the coat. The sentence however determined that the hotel director, during the hours when there is no custody service, must still ensure an appropriate standard of security given the risks ordinarily predictable and avoidable, and taking into account the nature and value of the hotel performance.

The Justice of the Peace for Bologna, in a recent ruling, upheld the claim for compensation of a client, who had suffered the theft of a laptop computer into the lobby of the hotel where he was staying (the case also extended to the vehicle parked inside the hotel).
